An Expert Witness Valuation is a formal opinion provided by a RICS qualified Valuer for use in legal proceedings, particularly in civil litigation, family law, or commercial disputes. The expert is appointed to assist the court, by providing an independent and impartial valuation of an asset, business, or property.

In England and Wales, expert witnesses must comply with Civil Procedure Rules (CPR) Part 35, which governs the expert’s duty to the court, overriding any duty to the party that instructs them. There is also a requirement to produce a CPR compliant expert report, including a statement of truth, and declaration of independence. Experts must demonstrate independence, relevant expertise, and give evidence in court if required.

Avery & Co provide Single Joint Expert (SJE) valuations whereby, we are appointed by both parties. Specifically, we provide valuations of property for matrimonial, and family law matters however, expert witness valuations are also commonly utilised for other purposes, including:

Shareholder/partnership disputes: Determining the value of a company or interest in a company.
Compulsory purchase: Valuing land or property taken by a public authority.
Litigation or arbitration: Valuing damages, loss of profits, or financial interests.
Tax disputes: HMRC investigations regarding business or property valuations.
